Model Pemberdayaan BUMDES Dalam Rangka Meminimalisir SDGs Desa Pasca Undang-Undang Cipta Kerja

Setiap orang mendambakan pekerjaan yang layak, maka berimpact terhadap peningkatan kesejahteraan ekonomi masyarakat. dalam prespektif undang-undang No. 13 tahun 2003 tentang Ketenagakerjaan diacu dalam pasal 96 mengatur terkait daluarsanya suatu kewajiban pemberi kerja untuk memberikan gaji/upah yang mana daluarsanya yaitu 2 tahun bila lebih dari 2 tahun maka kewajiban si perberi kerja untuk memberi gaji/upah akan hilang karena sudah lewat dari masa daluarsa tersebut. Yang mana telah dihapuskan dalam UU Cipta Kerja yang berdampak positif kepada para buruh/pekerja agar hak-haknya dipenuhi oleh pihak pemberi kerja.. Berbeda pengaturan di dalam UU Cipta Kerja, lebih menguntungkan para pekerja atau buruh. Tujuan penelitian ini untuk menganalisa inovasi UU Cipta Kerja terhadap para pekerja/buruh para buruh terkait SDGs Desa untuk mendapatkan Pekerjaan yang layak dan lebih sejahtera, selain itu pemberdayaan melalui BUMDES. Metode yang digunakan dalam penelitian ini dilakukan menggunakan metode yuridis normative yang mengkaji tentang permasalahan hukum dengan pendekatan konsep dan pendekatan peraturan perundang- undangan yaitu Undang- Undang No. 13 tahun 2003, Undang Undang No .6 Tahun 2023 tentang Cipta Kerja. Hasil Penelitian menunjukkan bahwa peningkatan SDGs Desa terkait pengurangan pengangguran, kemiskinan melalui pem-berdayaan masyarakat Desa (keberadaan BUMDES) sehingga menjadikan masyarakat menjadi mandiri dan sejahtera, adanya UU Cipta kerja buruh diberlakukan lebih manusiawi terhadap hak- hak yang akan diterima oleh para pekerja/ buruh. Rekomendasi dari penelitian ini segera membentuk Perdes terkait dengan pemberdayaan ekonomi bagi Masyarakat Desa.
