Abstract

Penataan Ruang Terbuka Hijau merupakan suatu wilayah dalam bentuk jalur serta pengelompokan yang manfaatnya lebih luas, jalur tersebut berisi tumbuhan tanaman yang tumbuh secara alamiah ataupun yang secara langsung. Sebagaimana yang telah tercantum dalam UU Penataan Ruang bahwa 30% pada perkotaan harus terdapat area hijau, dimana 20% untuk ruang publik dan 10% untuk privat. Tujuan penelitian ini untuk mengetahui pemanfaatan dan pengendalian Ruang pasca berlakunya UU No 6/2023 Cipta Kerja di Kabupaten Jember terutama di daerah perkotaan. Penelitian  ini  adalah yuridis  normatif,  artinya  penelitian  ini dilakukan dengan  mengkaji  berbagai  macam  aturan  hukum  yang  sifatnya  formal  seperti undang-undang,  literatur  yang  bersifat  konsep  teori  yang  kemudian  dihubungkan dengan   permasalahan   yang   menjadi   pokok   pembahasan. Pendekatan   yang digunakan  dalam  penelitian  ini: statute  approach (pendekatan perundang- undangan) dan  conceptual  approach (pendekatan konsep/ pendapat pakar). Hasil dari penelitian menjelaskan dalam UU No 26 Tahun 2007 Tentang Penataan Ruang terkait ketentuan mengenai muatan, pedoman, dan tata cara penyusunan rencana tata ruang wilayah provinsi dan kabupaten/kota diatur dalam peraturan Menteri, namun dalam UU No 6/2023 Cipta Kerja terdapat pembaruan ketentuan mengenai muatan, pedoman, dan tata cara penyusunan rencana tata ruang wilayah provinsi dan kabupaten/kota diatur dalam Peraturan Pemerintah. Berdasarkan uraian tersebut upaya pemerintah daerah dalam menanggulangi banjir dapat menggunakan beberapa ketentuan peraturan yang dicantum dalam UU Cipta Kerja.
